Scope and enforceability
These general terms and conditions of sale (hereinafter the "GTC") shall only apply if the following cumulative conditions are met:
The GCS become opposable to the Customers as soon as they tick the box provided for this purpose. They acknowledge having read them and having accepted them without restriction or reservation.
Validation of the order implies acceptance by the customer of the terms and conditions in force on the day of the order, which JOTT DIGITAL will keep and reproduce in accordance with the provisions of article 1127-1 of the French Civil Code. They shall prevail over any other version or any other contradictory document having the same object.
Territory: The Products presented on the Site are offered for sale in France and abroad.
Language The GCS and all contractual information mentioned on the Site are written in French.
Modification of terms and conditions JOTT DIGITAL reserves the right to modify the GTC at any time. Customers therefore undertake to consult them regularly. In the event of modification, the applicable terms and conditions will be those in effect at the date of the order.
Product specifications - Site information: The photos contained on the Site are for information purposes only. Customers are invited to refer to the description of each Product for precise characteristics; in case of doubt or request for additional information, customers are invited to contact JOTT DIGITAL.
JOTT DIGITAL makes every effort to provide users with quality information and/or tools, but cannot be held responsible for any direct or indirect damage that may result from accessing or using the Site. Despite all the care taken, a certain number of risks are inherent in the electronic transmission of information: delays, omissions or inaccuracies may occur. Ordering on the Site
Site access Access to the site is available via the Internet 24 hours a day, 7 days a week, except in cases of force majeure or events beyond JOTT DIGITAL's control, or for maintenance, updates or technical improvements, or for changes in content and/or presentation.
Account creation To place orders on the Site, the Customer must first create an account. To do so, the Customer must enter his e-mail address and a strictly confidential password. The customer will be solely responsible for the consequences of using his account until it is deactivated. To continue ordering, the Customer will be asked to provide additional information (title, first name, surname, exact delivery address, zip code, town, telephone number). The customer undertakes to provide true and sincere information and to inform JOTT DIGITAL of any changes concerning him/her.
Account deactivation JOTT DIGITAL reserves the right to deactivate the customer's account after sending an e-mail without effect for a period of 15 (fifteen) days, without compensation, in the event of non-compliance with all or part of the GTC. In the event of fraud on the part of a customer, the account will be deactivated without notice or compensation.
Placing an order To place an order, the Customer must follow the instructions on the Site. A summary of all the Products selected by the Customer will be displayed before the order is placed. The Customer must then validate the order by clicking on the appropriate icon.
Order confirmation The online sales contract is concluded when the customer clicks on the button to confirm the order and proceed to payment, after having viewed the details of the order and in particular its total price including VAT and the applicable delivery charges. This double "click", combined with the authentication procedure, constitutes a valid electronic signature.
Order modification Any modification of the order by the customer after confirmation of the order is subject to prior written acceptance by JOTT DIGITAL.
Stock availability Product offers are subject to availability. Indications concerning the availability of Products are provided at the time the order is placed. In the case of unavailable Products, JOTT DIGITAL may offer an equivalent Product in terms of quality and price or reimburse the Customer within a maximum of 30 (thirty) days from the date of the order.
Acknowledgement of order JOTT DIGITAL will confirm receipt of the order by sending an automatic e-mail listing the Products ordered, the price including VAT and shipping costs, and any difficulties or reservations relating to the order. JOTT DIGITAL reserves the right to refuse any order for legitimate reasons and more particularly if the quantities of Products ordered are abnormally high for buyers having the quality of consumers.
Rates - Payment
Current prices JOTT DIGITAL may modify its prices at any time, but the Products will be invoiced to Customers at the rates in effect on the Site at the time the Customer places the order.
The Prices indicated on the Site :
- are expressed in euros, excluding and including VAT;
- includes applicable taxes in force;
- does not include delivery and transport costs, which are invoiced in addition, depending on the choices made by the Customer at the time of the order as to the delivery of the Products ordered. The cost of the mode or time of transport or delivery (depending on the choice of the Customer) will be indicated at the latest at the time of confirmation of the order by the Customer.
Price characteristics Prices: Prices applicable on the day the order is placed are firm and non-revisable during their period of validity. The period of validity of Product offers and prices is determined by the updating of the Site.
Order payment Payment is made on the site either by credit card or via a Paypal account.
Invoice JOTT DIGITAL issues an invoice in the customer's name and sends it to the customer.
Archiving and proof: Communications, order forms and invoices are archived on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with article 1360 of the French Civil Code. These communications, order forms and invoices may be produced as proof of the contract.
Delivery
Delivery times Packages are generally dispatched within 1-2 working days (Monday to Friday before 12pm) after receipt of payment. Orders placed on Friday after 12pm, Saturday or Sunday, will be dispatched on the following Monday or Tuesday (excluding public holidays).
During busy periods (sales, holiday periods...), the preparation and dispatch of your order may take a little longer.
Terms of delivery Delivery means the transfer to the Customer of physical possession or control of the Product.
The Customer chooses one of the delivery methods offered by the Site when ordering. The Products ordered may be delivered in one or more shipments. Deliveries are made by an independent carrier.
Home delivery will be made during business hours, Monday through Saturday, excluding holidays.
The delivery in point relay La Poste and in post office will be carried out during the working hours, from Monday till Saturday, except public holidays.
Store pickup Customers can opt for in-store delivery. Delivery is free of charge. All Stores are eligible, except those listed below:

The delivery at residence - delivery against signature: will be carried out during the working hours, from Monday till Saturday, except public holidays. The delivery time in Metropolitan France is 2 to 3 working days (5 to 7 working days for Corsica) after shipment.
The delivery in point relay The post office and in post office: will be carried out during the working hours, from Monday till Saturday, except public holidays. The delivery time is 2 to 3 working days (5 to 7 working days for Corsica) after shipping.
Chronopost express delivery: will be made during working hours, from Monday to Friday, excluding public holidays. The delivery time in metropolitan France is 1 working day after shipment for orders placed before 12pm from Monday to Thursday.
Orders over €90 including VAT (excluding shipping costs) are exempt from shipping costs, for standard delivery in mainland France (including Corsica).
Germany, Belgium, Spain, Luxembourg, the Netherlands and Switzerland:
Delivery at home and in relay point (except Switzerland) - delivery against signature will be carried out during the working hours, from Monday till Saturday, except public holidays in 3-5 working days (except specific territories and delay of customs clearance).
DHL express delivery: will be made during business hours, Monday through Friday, excluding holidays. The delivery time is 1 working day after shipment for orders placed before 12:00 noon from Monday to Thursday.
Orders over €180 including VAT (one hundred and ninety euros) (excluding shipping costs) are exempt from shipping costs, for delivery in Germany, Belgium, Spain, Luxembourg and the Netherlands (excluding Andorra and Switzerland).
Austria, Italy:
Home delivery and delivery against signature will be made during working hours, from Monday to Saturday, excluding holidays in 3-5 working days (excluding specific territories and customs clearance time).
DHL express delivery: will be made during business hours, Monday through Friday, excluding holidays. The delivery time is 1 working day after shipment for orders placed before 12:00 noon from Monday to Thursday.
Other countries :
The delivery at residence - delivery against signature will be carried out during the working hours, Monday at Saturday, apart from the public holidays starting from 6 working days according to the destinations.
Orders cannot be delivered to post office boxes. The Products are delivered to the delivery address indicated by the Customer when placing the order.
The customer is solely responsible for any non-delivery due to an address error when creating their customer account. JOTT DIGITAL cannot be held responsible for any data entry errors and their consequences (delivery errors or delays). In this case, the costs incurred for the return of the order will be charged to the customer. JOTT DIGITAL cannot change the delivery address indicated in the order after shipment.
The times indicated do not take into account possible delays due to payment authorizations.
Delivery charges : The amount of delivery charges depends on the amount of the order and the delivery method chosen by the Customer. The amount of delivery charges is indicated to the Customer before the order is validated.
Shipping fees include handling and packing fees as well as postage costs. Consequently, the Customers are invited to group their purchases in a single order; otherwise they will have to pay the shipping costs for each order.

Taxes & Duties
The taxes are already included in the price of the product, but the customs duties, the extra community VAT, and the expenses of files related to the passage in customs remain with the load of the customer
Delay or failure to deliver: JOTT DIGITAL undertakes to use its best efforts to deliver the Products ordered by the Customer within the aforementioned deadlines. When the Product ordered is not delivered on the date or at the end of the period mentioned on the Site (except in cases of force majeure or maintenance periods), the Customer may, in accordance with Article L. 216-1 of the French Consumer Code, after having unsuccessfully enjoined JOTT DIGITAL to fulfil its delivery obligation within a reasonable additional period, cancel the contract by registered letter with reviews of receipt or by writing on another durable medium. The sums paid by the customer will then be returned to him without delay, to the exclusion of any compensation or deduction.
Transfer of risk : The risks of loss or damage to the Products are transferred to the Customer at the time he/she, or a third party designated by him/her, takes physical possession of the Product in accordance with the provisions of Article L. 138-4 of the French Consumer Code. The Product, which is delivered to the Customer by a carrier chosen by JOTT DIGITAL, travels at JOTT DIGITAL's risk.
Receipt When Products are delivered by a carrier to the address indicated on the order form, the Customer is responsible for checking that the Products delivered correspond to the order.
The Customer must then formalize his/her acceptance of the delivery by signing a delivery receipt issued by the carrier. If the Product arrives damaged, it is the Customer's responsibility to refuse to sign the delivery slip unless he/she makes reservations and refuses the package.
The customer must inform JOTT DIGITAL of any delivery problem in writing (letter or e-mail) within 3 (three) days of the delivery date.
Treatment of packages not delivered by the carrier: These are packages not delivered by the carrier that are returned to JOTT DIGITAL for the following reasons:
After receipt and acceptance of the parcel by JOTT DIGITAL, an e-mail will be sent to the customer informing them of the receipt of their parcel, indicating the reason for the return and proceeding with the reimbursement of their order.
Legal guarantees of conformity and hidden defects
Customer information :
The Products benefit by right and without additional payment and in accordance with the legal provisions:
- the legal guarantee of conformity, for the apparently defective, damaged or damaged products or not corresponding to the order and,
- the legal guarantee against hidden defects resulting from a defect in material, design or manufacture affecting the products delivered and making them unfit for use.
In this respect, we remind you of the provisions of articles L.217-4, L.217-5, L.217-12 and L.217-16 of the French Consumer Code, as well as articles 1641 and 1648 paragraph 1 of the French Civil Code relating to the existence and implementation of the above-mentioned guarantees:
Legal guarantee of conformity :
Article L.217- 4 of the Consumer Code
"The seller delivers a good in conformity with the contract and is responsible for the defects of conformity existing at the time of the delivery.
He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his expense by the contract or has been carried out under his responsibility."
Article L 217-5 of the Consumer Code
"The property conforms to the contract:
(1) Whether it is fit for the purpose ordinarily expected of similar property and, if so :
- If it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
- If it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L.217-12 of the Consumer Code
"The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good ".
Article L.217-16 of the Consumer Code
"When the buyer asks the seller, during the course of the commercial warranty granted at the time of purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization, of at least seven days, is added to the remaining warranty period. This period runs from the date of the buyer's request for service, or from the date the item in question is made available for repair, if the item is made available after the request for service.
In view of the above, the customer has a period of two years from delivery of the Product to take action against JOTT DIGITAL and may choose between repair or replacement of the Product ordered, subject to the cost conditions set out in article L.217-9 of the French Consumer Code.
The Customer can obtain the resolution of the sales contract or its reduction if the defect is major and the delay of the chosen solution exceeds one month from his request or if no modality of compliance of the Product is possible.
The Customer is exempted from proving the existence of the defect of conformity of the Product prior to the delivery of the Product and this during a period of 24 (twenty-four) months following the delivery of the Product.
If the Customer wishes to invoke the legal guarantee of conformity, he must send a registered letter with reviews to the following address: JOTT DIGITAL - 28 rue François Arago - 13005 Marseille and return the Product ordered with the invoice.
Legal warranty for hidden defects:
Article 1641 of the Civil Code
"The seller is bound by the warranty for latent defects in the thing sold which render it unfit for the purpose for which it was intended, or which so diminish that purpose that the buyer would not have acquired it, or would have given only a lesser price for it, if he had known of them."
Article 1648 paragraph 1 of the Civil Code
"The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect. two years from the discovery of the defect.
The Customer may therefore decide to implement the warranty against hidden defects in accordance with Article 1641 of the Civil Code; in this case, he may choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
If the Customer wishes to invoke the legal warranty for hidden defects, he must send a registered letter with reviews to the following address: JOTT DIGITAL - 28 rue François Arago - 13005 Marseille and return the Product ordered, enclosing the invoice.
JOTT DIGITAL will refund, repair or replace, as the case may be, the Products deemed to be non-conforming or defective, depending on the regime invoked by the Customer and subject to all the legal conditions of these two regimes being met.
Reimbursements for Products found to be non-conforming, defective or faulty will be made as soon as possible and at the latest within fourteen (14) days of JOTT DIGITAL noticing the non-conformity or hidden defect. Reimbursement will be made by crediting the Customer's bank account or Paypal account used to pay for the order.
JOTT DIGITAL cannot be held liable in the following cases:
- non-compliance with the legislation of the country to which the products are delivered,
- in case of misuse, professional use, negligence or lack of maintenance on the part of the Customer and,
- in case of normal wear and tear of the product, accident or force majeure.
JOTT DIGITAL does not grant any specific commercial warranty related to the Products.
Terms of return
The customer has a period of 30 (thirty) days following receipt of the order to inform JOTT DIGITAL of a return request and return part or all of the order.
The Customer is informed that only unworn, unstained, undamaged, unwashed items returned with tags, pouch/kit/cover intact will be accepted.
Returned items must be in resalable condition.
The customer must :

For each return, a document must be attached to identify the order.
4 - After receipt of the return in our premises, subject to compliance with the above steps, JOTT DIGITAL will proceed with the refund of the item(s) returned. Refunds are made within a maximum of 14 days after receipt of the package in the JOTT DIGITAL warehouse via the payment method used at the time of purchase (Paypal or credit card).
In case of return from a country concerned by customs duties, the Customer must mention that it is a return of goods on the customs declaration. Otherwise, the customs duties related to this return will be the exclusive responsibility of the Customer.
Depending on the bank processing time of the Customer's bank, the refund may take 5-10 business days to appear in the Customer's bank account.

In accordance with the provisions of article L. 221-18 of the French Consumer Code: " Consumers have a period of fourteen days in which to exercise their right of withdrawal from a contract concluded at a distance following canvassing by telephone or off-premises, without having to give reasons for their decision or incur costs other than those provided for in articles L. 221-23 to 221-25". In any case, these provisions do not apply to contracts concluded with professional Customers or Customers acting in a professional capacity.
Legal period In accordance with the provisions of article L. 221-18 of the French Consumer Code, the Customer has a withdrawal period of 14 (fourteen) days from the date on which the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the Products purchased. If the 14th day falls on a Saturday, Sunday or public holiday, this period is postponed to the next working day.

Product return: In the event of withdrawal by the Customer, the Customer must return the Product to JOTT DIGITAL - 28 rue François Arago - 13005 Marseille, without undue delay and, in any event, no later than 14 (fourteen) days after the Customer has informed JOTT DIGITAL of its decision to withdraw. This period is deemed to have been respected if the Customer returns the Products prior to the expiry of the 14 (fourteen) day period.
The direct costs of reshipping the Products shall be borne entirely by the Customer.
The Products must be returned within the above-mentioned period, complete, in their original packaging (plastic bag, box etc.), with the labels, bag/pouch etc. intact.
Effects:
Refund : In the event of retraction by the Customer, JOTT DIGITAL will reimburse all payments received from the Customer, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered by JOTT DIGITAL) without undue delay and, in any case, no later than 14 (fourteen) days from the day JOTT DIGITAL has received the Product(s) subject to the order, or until the Customer has provided proof of shipment of such Product(s), whichever comes first.
In case of return of only a part of the Products subject of the order, the modalities of refunding of the delivery charges will be as follows:
In the case where the delivery costs have been calculated according to the number of products ordered, they will be refunded in proportion to the Products returned by the Customer;
In the case of flat-rate delivery charges, they will not be refunded.
JOTT DIGITAL will proceed with the refund using the same means of payment that the Customer used for the initial transaction. With the express agreement of the Customer, another means of payment may be used. In any case, this refund will not incur any costs for the Customer.
Limits :
Product depreciation The Customer is reminded that, in the event of withdrawal after use of the Product(s), he/she is liable for any depreciation of the Product(s) resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product(s). According to the European Commission, these manipulations are those that a consumer can carry out in a store, for the goods offered for sale there. Consequently, the customer is informed that JOTT DIGITAL will check the conformity of the returned Products upon receipt. If the returned Product is not in conformity, costs for reconditioning and/or repackaging may be charged to the amount refunded to the Customer. Similarly, if the Product has been used beyond what is reasonably necessary to establish the nature and characteristics or proper functioning of the Product, JOTT DIGITAL reserves the right to apply a discount proportional to the use and depreciation of the Product.
Partial return In the event that the customer returns only part of the order, JOTT DIGITAL will reimburse only the amount of the returned Product. Furthermore, if the Product not returned was acquired free of charge at the time of the order, the Customer having benefited from a promotional operation, such as a sale with a bonus or a subordinate sale, JOTT DIGITAL will request the return of the free Product, failing which, the unit market value of the free Product, as shown on the JOTT DIGITAL website, will be deducted from the amount refunded to the Customer.
Applicable law - Disputes
Applicable law :
The GTC are subject to French law, subject to the mandatory rules of the country of residence of the Customer.
This provision does not deprive the Customer of the protection afforded by the mandatory rules of his country of residence. Thus, notwithstanding the choice of applicable law mentioned above, the Customer may always benefit from the mandatory provisions of his local law, when they are more favorable than the law chosen to be applicable in case of litigation.
Dispute resolution :
Amicable settlement In accordance with the provisions of Articles L. 612-1, L.616-1 and R.616-1 of the French Consumer Code concerning the amicable settlement of disputes, JOTT DIGITAL adheres to the Service du Médiateur de la consommation FEVAD (Fédération du e-commerce et de la vente à distance) whose contact details are as follows: Médiateur de la consommation FEVAD - BP 20015 - 75362 Paris cedex 8 - - France https://www.mediateurfevad.fr/.
After prior written application to JOTT DIGITAL by the consumer, the Mediation Service may be contacted for any unsuccessful consumer dispute. The customer may consult the terms and conditions of referral to the Mediation officer at the following address: https://www.mediateurfevad.fr/index.php/espace-consommateur/.
In addition, at the European level, the European Commission provides an online dispute resolution platform accessible at the following address: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.
Legal settlement In the event of failure to reach an amicable settlement, the Customer may bring any dispute relating to the existence, interpretation, conclusion, performance or termination of the GTCS before a court of law. The competent court in the event of a dispute shall be that of the defendant's place of residence or, at the plaintiff's option, the place of actual delivery of the Product.
E-Gift Card
Conditions of use of e-cards :
The E-gift card is exclusively valid for the purchase of products on www.jott.com. The E-Gift Card can be used as many times as desired, until its total amount is used up, during its validity period. When the purchase price exceeds the available balance of the E-Gift Card, the difference can be paid by any other means of payment accepted by JOTT on its website www.jott.com. JOTT E-gift cards are valid for 12 months from the date of purchase. They cannot be used after their expiry date. It is the customer's responsibility to check the expiry date of his or her e-gift card, which can be consulted at any time via the e-mail received at the time of purchase. Vouchers/discounts are not valid for the purchase of an e-gift card.
In the event of a product return, any product paid for with an e-gift card will be refunded to the same payment method used at the time of purchase, i.e. the e-gift card. The code and expiration date will remain the same, i.e. 12 months from the date of purchase for expiration. The balance available on the E-Gift Card will be the difference between the amount available before the purchase and the amount used to make the purchase.
The purchase and/or use of the E-gift card implies express and unreserved acceptance of these terms and conditions of use.
Withdrawal and returns of an e-gift card :
The E-gift cards being personalized products, they constitute an exception to the legal right of withdrawal of 14 days. The exceptions to the right of withdrawal are mentioned in the article L221-28 of the French Consumer Code. Personalized products are mentioned in the article L221-28-3°: E-gift cards cannot consequently give rise to any exchange, nor to any refund (total or partial) or to the exercise of a right of retraction, which the Customer recognizes and accepts by expressly renouncing his right of retraction during the validation of the order.

JOTT offers its customers a referral program which entitles the customer to a discount on a future order.

Any reference to "we", "us" or "our" in these Terms and Conditions means JOTT.
Any reference to "you", "your" or "the Member" refers to you as a member of the "LE CERCLE JOTT" loyalty program.
These general terms and conditions of use (hereinafter the "GTC" or "General Terms and Conditions") govern the Loyalty Program and apply to all participants from the moment they join.
Perimeter
The Loyalty Program is available on the online sales site www.jott.comoperated by JOTT DIGITAL (hereinafter "the Site"), for customers residing in France and in all JOTT Stores located in mainland France, with the exception of the following Stores :

JOTT Stores are outlets exclusively dedicated to the sale of JOTT brand products. Multi-brand stores and our second-hand store "REJOTT" are not participating Stores and are not part of the loyalty program network.
As the list of participating Stores is subject to change, anyone wishing to join the Loyalty Program is invited to consult our website. www.jott.com.
JOTT reserves the right to modify these GTUs. The GTUs can be consulted at any time on jott.com and by request to customer service.
How to join the loyalty program
Membership of the "LE CERCLE JOTT" loyalty program (hereinafter referred to as "Membership") is open to natural persons only and can be purchased at participating Stores or directly on the website www.jott.com. Membership of the loyalty program is strictly free of charge and is not subject to any purchase conditions.
To join :
- in a JOTT Store : just ask a sales consultant.
- on the Site: when you create your account, by entering your email address. If you already have an account: your membership is automatic.
The Program is dematerialized and the loyalty card will be sent to the Member's e-mail address the day after registration (d+1).
When you apply for membership, you will be asked to provide certain mandatory and optional information, as indicated below:

It is your responsibility to update your personal information by changing it with a salesperson in one of the participating Stores , or directly on your Customer Area on the Site. Loyalty program membership conditions
LE CERCLE JOTT is open to individuals aged 18 and over.
Membership is strictly personal, and only you can benefit from the advantages described below.
Use by any third party is forbidden and will not be accepted by any vendor when presented at the checkout.
You may only have one loyalty account. In the event that an email address or cell phone number is associated with more than one loyalty account, we reserve the right to merge said loyalty accounts into a single loyalty account.
Your customer area
To access your personalized area ("Customer Area") on the Site following a JOTT Store Membership, you will need to activate it by entering the same email address provided at the time of your membership and create a password on the website.
If you become a Member on the Site, you will have access to your personalized area (hereinafter referred to as the "Customer Area"), accessible on the website, within twenty-four (24) hours of becoming a Member. To access your Customer Area, you will need to enter your e-mail address and the password you registered when you joined.
Your Customer Area allows you to :
- access your loyalty account,
- check your loyalty status, your number of points and the amount of your available kitty
- consult your purchase history,
- modify your personal data,
- view and access your benefits
Availability and use of the customer area
We provide you with the Customer Area. We cannot guarantee its availability and uninterrupted operation 24 hours a day. Access may be interrupted unpredictably for technical or maintenance reasons. Nevertheless, JOTT undertakes to do its utmost to ensure continuity of access and use of the Site 7 days a week, 24 hours a day.
It is your responsibility to protect your computer, tablet or telephone. We cannot be held responsible for any damage to your computer, tablet or phone, or for any loss of data that may result from your use of the Customer Centre or from fraudulent use by a third party.
User's personal data
The personal information provided by the Member as part of the loyalty program is strictly confidential and will be used exclusively by JOTT, as data controller (where applicable with the JOTT franchise network: co-controller), for the sole purpose of operating the loyalty program and keeping the Member informed, with his/her explicit consent, of the brand's special offers. In this respect, this information will be kept for a period of five (5) years after the last active contact with JOTT.
Our privacy policy is accessible via the url https://jott.com/policies/privacy-policy. This Privacy Policy is an integral part of these Terms and Conditions. Acceptance of the Privacy Policy is a condition of use of the Loyalty Program.
By using the loyalty program, contacting our customer service department or registering in our prospect database, you explicitly agree to this privacy policy and to the processing of the personal data you provide in accordance with it.
Pursuant to the French Data Protection Act of January 6, 1978 as amended, and the European General Data Protection Regulation of April 27, 2016 n°2016/679, the Member has the right to access, rectify, delete, port, limit and oppose the processing of data concerning him or her, as well as the right to define directives concerning the fate of his or her data after his or her death, with JOTT and for the duration of the existence of the Loyalty Program, by contacting Customer Service. Members wishing to exercise their rights must send their request together with a copy of an identity document.
Members may withdraw their consent at any time, and lodge a complaint with a supervisory authority.
Members who exercise their right to delete, limit or oppose the processing of their personal data will be deemed to have waived their right to use the loyalty program.
How the "LE CERCLE JOTT" program works
The program is structured to offer certain benefits, some of which are only available to certain types of members.
The loyalty program has four (4) statuses:
- status 1 "LEMON YELLOW", from 1 to 349 points
- status 2 "PRESSED ORANGE", from 350 to 749 points
- Status 3 "RED CHILDREN", from 750 points to 1499 points
- status 4 "BLACK TORREFIED", at 1500 points or more.
You can join the loyalty program without making a purchase, but you must make a purchase in order to collect points and acquire benefits.
- Earn Loyalty Points
Membership of the Loyalty Program entitles you to 30 free points upon registration.
Loyalty points are earned according to the amount of purchases made by the member. For every 1 euro spent, the member earns 1 loyalty point (excluding the amount spent on delivery, which does not earn points).
Whatever your status, in order to accumulate points from your purchases, you must log in at each checkout (before paying for your purchases) or on the site, when confirming your order, so that your loyalty account can be retrieved and credited.
If a purchase or order is made without your identification, the points associated with that purchase will not be added to your points account.
The scale for obtaining loyalty statuses is freely defined by JOTT, which may modify it at any time and at its sole initiative. In the event of modification, you will be informed of the new scale in force by any means we deem useful and appropriate, such as, for example and without this list being limitative, by posting in JOTT Stores or by updating the General Conditions on the Site and in the Customer Area.
Purchases made (whether in a JOTT Store or on the Site) on the day of Membership will be taken into account if membership to the loyalty program has been requested prior to payment. Loyalty Points earned in Store and on the Site will be added to your Loyalty Account within twenty-four (24) hours of purchase.
It is specified that :
- in the case of a product return with a refund, your loyalty points balance will be decremented by the number of loyalty points corresponding to the refund;
You can freely consult the number of loyalty points accumulated directly on your Customer Area or by requesting it from a JOTT Store salesperson.
Your loyalty points earn you euros, which you can deduct from your next purchase. The principle is that 100 points entitle you to a €5 discount (and therefore 200 points to a €10 discount, 300 points to a €15 discount, etc.), with no limit. The discount scale is freely defined by JOTT, which may modify it at any time on its own initiative. In the event of modification, you will be informed of the new scale in force by any means we deem useful and appropriate, such as, for example and without this list being limitative, by posting in JOTT Stores or by updating the General Conditions on the Site and in the Customer Area.
The levels and methodologies for accumulating points are freely defined by JOTT, which may modify them at any time on its own initiative. In the event of modification, you will be informed of the new scale in force by any means we deem useful and appropriate.
- How do you go from one status to another?
Membership of the LE CERCLE JOTT program entitles you to status 1: Lemon Yellow. To move from one status to another, you must accumulate a certain number of loyalty points based on the amount of your purchases. Your loyalty points are valid for 12 months after your last purchase. Each purchase extends the validity of your points over 12 months.
To pass :
- to status 2: ORANGE PRESSÉE, you must earn at least 350 loyalty points
- at status 3: PIMENTÉ RED, you must earn at least 750 loyalty points
- at status 4: BLACK TORREFIED, you must accumulate at least 1,500 loyalty points
- The status change gift
Purchases are taken into account when calculating points and status within 24 hours of purchase. Your points are definitively validated after 30 days. This means you can enjoy the benefits of your status 30 days after purchase.
In Store, the seller will inform you of your right to the new status gift and may offer it to you. On the website, your loyalty gift can be added to your basket. You will also receive an email confirming your status change.

Please note that each time you change status and the associated JOTT gift is issued, your points balance will not be deducted from the number of Loyalty Points required to reach the new status. Loyalty Points will continue to be accumulated.
Converting your points into euros
At any time, you can decide to use your points to convert them into a € discount on your purchases. Your points will then be deducted from your kitty, but you will retain your loyalty status. The only time your loyalty points and status are lost is if you go 12 months without making a purchase.
Points can be used in participating Stores (excluding department store corners).
Members can only use the points available in their balance.
When purchasing online on the jott.com website, Members can freely choose the amount of points they wish to redeem by entering them in their shopping cart when paying for their order.
In the case of Store purchases, members can decide on the amount of discount they wish to receive by telling the Store sales host(s) the amount of points they wish to redeem at the time of payment.
Discounts linked to the use of points are valid without a minimum purchase. They cannot be combined with any other offer or promotion currently in effect, or on items marked down during sales periods and other commercial operationsBlack Friday, private sales, etc.). The kitty cannot be used to purchase gift cards or second-hand items (REJOTT).
The kitty can only be used for 100 points or more, and in €1 increments (i.e. 20 points).
The benefits of LE CERCLE JOTT
LE CERCLE JOTT gives you access to special offers, as described below, depending on your status.
As part of the program, you can benefit from advantages on the repair of your JOTT down jackets, depending on your Status (detailed below). Repairs are carried out by a third-party company, Point Nommé ("Les Réparables").
Your loyalty advantage will be applicable to your down jacket repair requests, made via the URL jott.lesreparables.fr. Promotional codes are not applicable to shipping costs for sending/receiving the Product to be repaired, which remain your responsibility.
Promotional codes are only valid for repairs to JOTT down jackets. Requests for repairs on other ready-to-wear items, shoes and Accessories will not be honored. JOTT cannot be held responsible for any prejudice of any kind suffered by Point Nommé and/or the Member, whatever the cause or origin.

Status 4 gives you access to the following benefits:

You will be informed of these promotions by any means we deem appropriate and suitable (such as, but not limited to, displays in JOTT Stores or on the Site, mail, email, SMS, etc.).
Refer a friend : Refer a friend directly via the url https://jott.com/pages/parrainage. You and your sponsored friend will receive a €15 discount on their first order (valid from €150 purchase on jott.com).
Exchange without receipt for 30 days following purchase. We allow you to exchange any item purchased in a JOTT Store that is in your Loyalty Account purchase history, without having to provide us with the sales receipt. Reward conditions
As soon as the conditions for obtaining a JOTT reward have been met, you will be informed either directly by your sales assistant at a JOTT Store when you check out, or when you validate your points on the Site. You will also be notified of the award by email.
To collect your gift, go directly to a participating JOTT Store or to your customer area. Your birthday gift must be collected within one month of your birthday. Upgrade gifts must be collected within 3 months of upgrading to a higher status.
Please note that vouchers cannot be combined with other promotions or sales .
Reward exchanges are not provided for. In addition, JOTT gifts will never be refunded.
In the event of a JOTT gift being out of stock in a Store, we undertake to replace it as quickly as possible with a product of the same nature and/or value, depending on the status reached. If a Store is out of stock, you can go to another participating Store to access your reward.
Loyalty benefits
Loyalty benefits are described in your Customer Area on the www.jott.com website.
JOTT reserves the right to modify them without prior notice, and invites Members to consult them regularly on the www.jott.com website.
Liability
JOTT's general obligation is an obligation of means. JOTT has no obligation of result or reinforced means of any kind. We shall not be held liable for any damages arising from the services or benefits provided under the LE CERCLE JOTT program.
By way of example, JOTT declines all responsibility in particular:
- In the event of temporary inability to access the loyalty program's functionalities for technical maintenance or updating of published information. JOTT will do its utmost to inform Members of such interruptions. Members acknowledge that JOTT may not be held liable in the event of malfunctions or interruptions of said transmission networks;
- In the event of virus attacks or unlawful intrusion into an automated data processing system;
- In the event of abnormal use or illicit exploitation of loyalty program functionalities by a Member or a third party;
- In the event of non-compliance with these GCU attributable to the Member ;
- In the event of delay or non-performance of its obligations, when the cause of the delay or non-performance is linked to a case of force majeure as defined in article 1218 of the French Civil Code;
Fraudulent use
LE CERCLE JOTT is a program designed to reward Members for purchases made in participating Store or on the Site. This assumes that the Member respects the General Terms and Conditions and behaves fairly towards the brand.
Also :
(i) any breach of the General Conditions ;
(ii) any fraudulent use by the Member of the LE CERCLE JOTT Program or by any third party acting on behalf of the Member;
(iii) any action intended to disrupt the Loyalty Program, the Site or any JOTT Store ;
(iv) any abnormally high number of transactions on a single day or over several days;
(v) any payment not settled within thirty (30) days of the date of purchase;
will automatically result in the cancellation of all Loyalty Points, as well as the deactivation and deletion of the Loyalty Account without compensation or indemnity of any kind.
We reserve the right to carry out checks on compliance with the General Terms and Conditions at any time. JOTT reserves the right to restrict, suspend or terminate the Member's access to his or her account and the accumulation of loyalty points in the event of a breach of these GCU. In this case, JOTT will notify Members prior to any termination of their account.
Reset loyalty points to zero
If you do not make a purchase for a consecutive period of twelve (12) months, your points counter may be reset to zero. We will then inform you, by email (subject to knowledge of the email address), that if you have not made a purchase within thirty (30) days of receipt of said email, your points balance will be reset to zero, which will demote you to status 1, without compensation or indemnification of any kind.
Modification or termination of the loyalty program
We reserve the right to modify or cancel the loyalty program (membership conditions, loyalty account benefits, etc.) and/or the terms of use of the loyalty account at any time. In the event of termination of the program, we will give you the opportunity to use the points you have accumulated for a period of one (1) month, following notification by any means we deem appropriate. If you fail to use these points, your loyalty advantages will be definitively lost.
No Member shall have any recourse against JOTT for any reason whatsoever. No modification or deletion will entitle the Member to compensation.

No waiver
The fact that one or other of the parties does not act under the General Terms and Conditions does not constitute a waiver of the right to act, unless expressly waived in writing.
General stipulations
These Terms and Conditions are only available in French.
Membership of the LE CERCLE JOTT program implies full and unreserved acceptance of the General Terms and Conditions. The General Conditions may be consulted or obtained, on request, in JOTT Stores , on the Site or via the contact form on the site: https://faq-jott-fr.gorgias.help/fr-FR/contact
The General Terms and Conditions are governed by French law. If any provision of these Terms and Conditions is held to be invalid, void or unenforceable for any reason, such provision shall not affect the validity and enforceability of the remaining provisions of the Terms and Conditions.
